What you keep if you file in Alberta
Most people worry about losing their home or their car. In a consumer proposal, you don’t hand over any assets at all, so the limits below don’t apply. You keep what you own and repay part of what you owe over time.
In bankruptcy, Alberta law protects a set amount of your property from creditors.

Going over a limit doesn’t automatically mean losing the asset. You can often keep it by paying the difference, or by filing a consumer proposal instead. RRSPs and RRIFs are protected under federal law either way, apart from contributions in the 12 months before you file.

A Licensed Insolvency Trustee is a professional licensed and regulated by the Office of the Superintendent of Bankruptcy Canada. In Edmonton, a trustee is the only professional who can legally file and administer a consumer proposal or bankruptcy. The first consultation is free, private, and there’s no obligation to file.
Yes. The moment your trustee files a consumer proposal, a stay of proceedings stops wage garnishments, collection calls, and most creditor actions. This matters in Alberta, where only the first $800 of your monthly net income is fully exempt and creditors can take half of what you earn between $800 and $2,400. Filing stops the garnishment right away.
Alberta protects up to $40,000 of equity in your principal residence, one of the highest exemptions in the country. If your equity is below that, your home is safe in a bankruptcy. If it’s above, a consumer proposal usually lets you keep the home and pay creditors over time instead.
Probably, if you have steady income and owe less than $250,000, not counting your mortgage. You need enough coming in to cover a monthly payment after your essentials, and your offer has to give creditors more than they’d get if you went bankrupt. Sometimes, yes. A consumer proposal is based on what you can afford to repay, and the rest is forgiven, so the reduction depends on your income, your assets, and what your creditors will accept. Some people cut their debt by a large amount, others reduce it by less. Your trustee shows you the actual figure before you agree to anything.
