You must include all your unsecured debts in a proposal.
To qualify for a consumer proposal:
- Your debts must be under $250,000, excluding your mortgage.
- You must be unable to pay your debts as they come due and owe more than your assets are worth.
- You should also be able to make a monthly repayment after essential bills.
- You must offer creditors more than they would get in bankruptcy.
Bankruptcy is a legal process under Canada’s Bankruptcy and Insolvency Act that provides relief when you can no longer meet your financial obligations.
By surrendering some of your assets and agreeing to specific responsibilities, you are freed from overwhelming debt.
Bankruptcy isn’t a sign of failure; it’s a legal safety net meant to help people make a fresh financial start.
